Welcome to Gifture. These Terms of Service ("Terms") govern your use of the Gifture mobile application ("App") operated by Ardify ("we", "us", "our"). By creating an account or using the App, you agree to these Terms.

1. About Gifture

Gifture is a gift recommendation platform that helps you discover gift ideas for people and occasions. The App allows you to:

  • Create profiles for people you want to buy gifts for
  • Receive personalized gift suggestions
  • Save and organize gift ideas
  • Track special dates and events
  • Access product links from third-party retailers

Gifture is not a marketplace, seller, or distributor of products. We do not sell, stock, or fulfill any products shown in the App. All purchases are made directly with third-party retailers.

Gift recommendations are generated automatically and provided for informational purposes only. Suggestions may not always be accurate, complete, or suitable for your needs.

2. Account Registration

To use certain features, you must create an account using your email address, Google account, or Apple ID. You agree to:

  • Provide accurate and complete information
  • Keep your login credentials secure
  • Notify us of any unauthorized access
  • Be responsible for activity under your account

You must be at least 13 years old to use the App. If you are under 18, you must have parental or guardian consent.

3. Affiliate Links and Third-Party Products

The App displays product recommendations that link to third-party retailer websites.

a) Affiliate Relationships

Some links are affiliate links and may include tracking parameters for attribution. We may earn a commission if you click a link or make a purchase, at no additional cost to you.

b) Third-Party Transactions

All purchases occur on third-party websites. We are not a party to those transactions. Pricing, availability, shipping, and returns are governed by the retailer's terms.

c) No Guarantee

Product details, prices, and availability may change. We do not guarantee accuracy or completeness of third-party product information.

d) No Endorsement

Displayed products are suggestions only and do not represent guarantees of quality or suitability.

4. User Content

You may upload content such as profile images and notes. You retain ownership of your content but grant us a limited license to store and display it within the App to provide our services. You agree not to upload unlawful or harmful content or content that violates others' rights.

5. Push Notifications

With your permission, we may send push notifications for reminders, recommendations, and important updates. You can disable notifications at any time in App or device settings.

6. Account Deletion

You may request account deletion through App settings. When requested:

  • Deletion is scheduled with a grace period
  • You may cancel during the grace period
  • After the grace period, data is permanently deleted
  • Some data may be retained where legally required

7. Intellectual Property

The App and its content, features, and branding are owned by Ardify and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer the App without written permission.

8. Prohibited Conduct

You agree not to:

  • Use the App unlawfully
  • Attempt unauthorized access
  • Disrupt or interfere with functionality
  • Create deceptive multiple accounts
  • Scrape or harvest data without permission
  • Distribute spam or malicious content

9. Service Availability and Changes

We may modify, suspend, or discontinue any part of the App or its features at any time without prior notice.

10. Termination

We may suspend or terminate accounts that violate these Terms or misuse the App.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARDIFY IS NOT LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE APP OR THIRD-PARTY PURCHASES.

13. Changes to Terms

We may update these Terms from time to time. Continued use after updates means you accept the revised Terms.

14. Governing Law

These Terms are governed by applicable laws. Disputes will be resolved through appropriate legal channels.
